OBJECT OF THE ONLINE CONTRACT AND ITS DESCRIPTION
By "online" sale contract is meant the distance contract and that is the legal transaction concerning movable goods and / or services entered into between a supplier, in this case the tinelli.it website of the Tinelli company & C. SRL, with headquarters in Viale Vicenza 4C, Valence Al 15048, registration number of the Chamber of Commerce AL-162805, P. Vat 01464860061 and a consumer customer as part of a distance selling system organized by the supplier who, for that contract, uses only the remote communication technology called "internet". All contracts, therefore, will be concluded directly through access by the customer consumer to the website corresponding to the tinelli.it address where, following the indicated procedures, will conclude the contract for the purchase of the asset. By consumer is meant the natural person who purchases goods and services for purposes not directly related to any professional activity. The following are the conditions of sale which will remain effective until changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website www.tinelli.it and will refer to sales made from that moment on.
SALE PRICES
All sales prices of the products displayed and indicated on the site include VAT (for the countries where it is applied) and the customer can pay for the goods ordered with the payment methods indicated online at the time of purchase. The prices shown on the site are valid only for orders placed online.
The purchase invoice will be issued only if expressly requested in its place, a delivery note will still be provided which will be equally authentic as proof and ownership of the purchase also for the purposes of the legal guarantee and possible exercise of the right of withdrawal.
For non-EU countries the price is exclusive of taxes and import costs which are to be paid by the customer.
AVAILABILITY IN STOCK
If the purchased product is not immediately available in stock, will be edited by Tinelli & C. SRL communicate the times of availability of the same and send it as soon as possible.
DESCRIPTIONS AND PRODUCT IMAGES
All product descriptions published on the tinelli.it site are, as far as possible, updated and accurate. Equally the images of each product are as accurate as possible, however, they may differ insignificantly from the product purchased, for example in color, in shape and size.
For a better display of the products offered, some images are enlarged compared to the original and therefore not to scale 1:1.
CARAT WEIGHT, SHAPES AND COLORS OF PRECIOUS STONES
Some characteristics of the jewelry stones on sale as carat weight, shape and color are to be considered indicative and may undergo slight variations in increase or decrease compared to what is indicated in the respective analytical data sheets of the products in such a way as not to bring significant changes to the overall value or to the appearance of the jewel. If these changes were such as to increase the overall value of the jewel, no adjustment amount will be requested from the customer.
PACKAGING
All purchased products are sent in packs at no additional cost. The packages may vary in shape and color compared to those published on the site which are therefore to be considered purely indicative.
Certified diamonds set in jewels will be accompanied by their certificate.
DELIVERY METHODS, SHIPMENTS AND RELATED TIMES
Tinelli & C. SRL ships FREE throughout Italy through its selected couriers. All goods travel insured. For the remaining countries, any costs borne by the buyer are possible and will be calculated from time to time, due to the various factors that contribute to establishing the cost of a shipment.
In case of absence of the recipient at the time of delivery, a notice will be left and the customer must personally contact the courier or shipper as soon as possible to agree on the delivery methods.. For the withdrawal of each shipment, signature by an adult is required. The shipping address is the one indicated by the customer when purchasing online, unless otherwise agreed in advance between the parties in writing. At the time of shipment we will show a photo of the package as shipped to verify its congruity with what the customer will receive at the time of delivery. If there are differences (probably due to tampering) it is necessary to sign with "reservation of control". Otherwise we will not be able to refund any breakages or damage to the product purchased.
In no case will shipments be made to PO boxes, mail boxes e simili.
The delivery of the purchased item will take place within 30 working days from the date of payment. This indication applies to deliveries in Italy, for all other destinations the timing will be calculated from time to time.
RESPONSIBILITY
Tinelli & C. SRL does not assume any responsibility for the disservices attributable due to force majeure such as accidents, explosions, fire, strikes and / or lockouts, earthquakes, floods and other similar events that prevented, in whole or in part, to execute the contract within the agreed time. Tinelli & C. SRL will not be liable to any party for damages, losses and costs incurred as a result of the non-execution of the contract for the reasons mentioned above, having the consumer entitled only to the refund of the price paid. In the same way, Tinelli & C. SRL is not responsible for any fraudulent or illegal use that may be made by third parties, credit cards and other means of payment, upon payment of the purchased products.
GUARANTEES
For products that foresee it because of the type of goods they represent, Tinelli & C. SRL offers a minimum guarantee from the date of purchase.
OBLIGATIONS OF THE PURCHASER
The consumer is committed and obliged, once the "online" purchase procedure is completed, to provide for the printing and conservation of these general conditions, that, moreover, will have already viewed and accepted as an obligatory step in the purchase , as well as the specifications of the product being purchased, and this in order to fully satisfy the condition set out in articles. 3 e 4 of the Decr. Legisl. n° 185/1999. Moreover, it is strictly forbidden for the buyer to enter false data, and / or invented, e / o in fantasy, in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and e-mail must be exclusively their real personal data and not of third parties, or fantasy. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. Tinelli & C. SRL reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.
CONTRACTUAL RESOLUTION AND EXPRESS TERMINATION CLAUSE
Tinelli & C. SRL has the right to terminate the stipulated contract by simply communicating it to the customer with adequate and justified reasons; in this case, the customer will only be entitled to the refund of any sum already paid. The obligations assumed by the customer pursuant to art. 7 (Obligations of the buyer), as well as the guarantee of successful payment that the customer makes with the means referred to in art. 2, they have an essential character, so that by express agreement, default, by the customer, of only one of these obligations will determine the legal termination of the contract pursuant to art.1456 of the civil code, without need for judicial judgment, without prejudice to the right for Tinelli & C. SRL to take legal action for compensation for further damage. The customer has the right to cancel the contract within 24 hours from receipt of the confirmation email giving timely communication to customer service via email at ltinel@hotmail.it.
CONFERENCE AND PROCESSING OF PERSONAL DATA
Personal data are collected for the purpose of registering the customer and activating the procedures for the execution of this contract and the related necessary communications.; these data are processed electronically in compliance with the laws in force and can only be presented upon request of the judicial authority or other authorities authorized by law for this purpose. Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the contract stipulated and disclosed exclusively for this purpose. The interested party enjoys the rights of the Decree. Legisl. 196/2003 (Code regarding the protection of personal data) that is: to ask for confirmation of existence at Tinelli & C. SRL of their personal data; to know their origin, the logic and purpose of their treatment; to get the update, rectification and integration; to ask for their cancellation, transformation into anonymous form or block in case of illegal treatment; to oppose their treatment for legitimate reasons or in the case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication. The owner and manager of the collection and processing of personal data is the Tinelli company & C. SRL.
JURISDICTION AND JURISDICTION
Any dispute related to the application, execution, interpretation and violation of the purchase contracts stipulated "online" through the website tinelli.it is subject to Italian jurisdiction; these general conditions are shown, although not expressly provided therein, in conjunction with Legislative Decree n 50 of the 15.1.1992 and of the legislative decree n ° 185 of the 22.5.1999. For any controversy between the parties regarding this contract, the Court of Alessandria will be competent.
RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the contract in the cases expressly provided for by art. 59, first paragraph, of d.Lgs.N.206 / 2005, without indicating the reasons, within 14 days since you received the product (in the case of purchasing multiple products, delivered separately with a single order, received the latest product).

This deadline will be respected if you carry out the shipment before the expiry of the fourteenth day.
The goods must be returned in perfect condition, in particular, the jewel and / or the watch must be in the same condition in which they were received, including packaging, packs, hang tags, seals etc.. The tags must be intact and attached to the jewel and / or watch.
In the case of damage to jewelry and / or watches, such as scratches or evidence of wear due to improper use, that is, different from that of establishing its nature, its characteristics and functioning, you will be held responsible for the decrease in value of the jewel, this decrease will be communicated to you via email.
In the case of a correct and legitimate right of withdrawal, we will refund the full amount paid including any delivery costs. Refunds will be made using the same payment method used for the initial transaction, unless you request a refund on a different means of payment, in which case any additional costs deriving from the different means of payment chosen by you will be at your expense.
The refund can be suspended until the goods are received and until the goods have been delivered in compliance with the above description and in perfect condition..
The refund for non-EU sales will be equal to the amount paid to us by the customer after deducting the costs for the customs re-import operation.
EXCLUSION OF THE RIGHT OF WITHDRAWAL
We inform you that pursuant to art. 59, first paragraph, letter c) of the D. Decree. n. 206/2005 (Consumer Code), the right of withdrawal is excluded in relation to the supply of "customized or clearly personalized products". With reference to the aforementioned case of exclusion of the right of withdrawal, you are informed and accept that the "products made to measure or clearly personalized" include the products indicated as customizable in the relative information sheet, after their personalization if requested by you.
